This class action lawsuit, led by Sainte-Marthe-sur-le-Lac resident Richard Lauzon, alleges that the breach of a faulty dam on April 27, 2019, caused an undue inconvenience to individuals who own or reside in buildings in Sainte-Marthe-sur-le-Lac and were affected by the resulting flooding (the case against the Deux Montagnes regional county municipality (MRC) has since been withdrawn).

Proposed Class

You are a member of the Class if you meet criteria A or B below:

A. Any person (of legal age or emancipated) who owns a property, located on the territory of the Town of Sainte-Marthe-Sur-le-Lac, which was damaged by water following the breach of the dam on April 27, 2019; 

B. Any person (of legal age or emancipated) residing in a building, located on the territory of the Ville de Sainte-Marthe-Sur-le-Lac and which was damaged by water following the breach of the dam on April 27, 2019; 

All persons meeting these criteria could be entitled to compensation if the class action lawsuit is successful.

Remedies Sought

The class action claims financial compensatory damages intended for each member of the Class as remedy of their prejudice, the amounts of which will be the subject of detailed proof at the merits stage of the class action (the merits stage of the class action is the trial in progress after the authorization obtained from the Superior Court).
